MEDICAL MALPRACTICE

If you or a loved one is injured as a result of the negligence of a medical provider, such as a doctor or hospital, you could be entitled to compensation as well. Common types of malpractice include: improper diagnosis, surgical mistakes, objects left in body, improper transfusion, prescription drug reactions, and even mistaken identity.

Unfortunately the rules for holding medical providers liable have become much more difficult across the country and especially in Texas. The Texas legislature has put up several legal hurdles a person must jump over before they can even file suit in their case. They also require the injured party to hire a medical expert to prepare a special report that must be filed within a short period of time after the lawsuit is filed. These reports typically cost $1000's of dollars. If such a report is not prepared properly and filed in time, the person can end up having their case thrown out of court.

The Legislature has also limited the amount of damages a party may be entitled to, no matter how serious their injuries are or how bad the mistake. The limits are typically $250,000. That means that even if you win your case, you might not get enough compensation to make you whole again. Like most other law firms, we are very selective in the types of cases we are willing to take on these days.

PRESCRIPTION DRUG COMPLICATIONS & REACTIONS
