DRIVING WHILE INTOXICATED (DWI)
DWI's are one of the most common crimes out there. It is very easy for the average law abiding citizen to get arrested for DWI. If you have even 1 or 2 drinks at dinner and then drive home, you are at risk for being pulled over and charged with this offense.
LICENSE SUSPENSION & ALR HEARINGS
Unfortunately, DWI is one of the most costly and complicated types of misdemeanors to deal with. First of all, as soon as you are arrested the police officer will take your driver's license away from you. You will automatically end up with at least a 90 day license suspension if you do not take the proper actions within 15 days to request a hearing to contest the suspension. This is another reason why it is so important to contact our office as soon as you are released from jail.
We can properly prepare and file the paperwork to request an Administrative License Revocation (ALR) hearing on your behalf. This will put an automatic stop to the suspension until we get a chance to review the details of your case. If we are able to win this hearing, you will not have to deal with an ALR suspension.
OCCUPATIONAL LICENSE
If your license does become suspended, we can help you get a special "occupational license." This will allow you to continue driving to go to and from work, school, doctor, etc, and perform all necessary houseshold tasks.
The judge can place time and day restrictions, but we are usually able to get them to be effective 7 days a week, from 7:00 a.m. to midnight.
In order to get this license, there are several fees you will have to pay. You will have to pay the filing fee to the court of $350 (as of 10/22). You will have to get an SR-22 insurance form which can also cost a few hundred dollars. You will also have to pay a license reinstatement fee to Texas Department of Public Safety (DPS) of $135.
OBSTRUCTION OF A ROADWAY CHARGE OPTION
The Bexar County DA's Office sometimes offers an alternative to a DWI conviction in certain cases. If you are a first time offender, and there are extenuating circumstances, you may qualify for this program. You may not end up with a conviction on your record with this option. Plus you will not have to face the a potential 2nd license suspension & surcharges. It is worth it for some of our clients who have a really bad case.
