Traffic tickets can be very expensive today, and result in a significant hike in your insurance rates if they show up on your record. Also, in 2005, the Texas Department of Public Safety started a new “point system” which can result in suspension of your driver’s license with certain traffic convictions on your record. You could be forced to pay a “surcharge” of several hundred dollars for 3 years in a row.

With the hundreds of traffic laws out there, each one of us is at risk for being pulled over and cited. While it is usually not worth the expense of actually going to trial on these cases, it is worth the money to hire a lawyer to try and keep them off your record.

WE CAN POTENTIALLY HELP GET CASES DISMISSED & FINES REDUCED

Our office can scrutinize your ticket and the Texas Transportation Code to see if there is any way to get your ticket thrown out on a technicality right off the bat. If it cannot be thrown out, it can usually be kept it off your record (with the exception of tickets involving CDL’s). If you have more than one ticket, we can usually get one dismissed in exchange for another paying off another. In addition, we can usually get the fines on the other tickets reduced as well.

Also, it is often possible to get your case reset for a couple of months to buy you some time to pay. And of course, with an attorney on the case, you are generally saved the hassle and inconvenience of going to court yourself. This is especially important for those people who have already missed their court date and now have a warrant out for their arrest, or for people who have gotten a ticket out of town and don't want to drive all the way back to where the court is located to fight it.

Once we work out a deal for you, we will require you to pay the fine. Sometimes the court may order you to take Defensive Driving (mandatory if you are under 25), or some other type of classes. We have provided a list below of the agencies that offer such classes. We will let you know what is required by the court, but once you take the class you do need to provide proof to the Court that you have completed the required classes. LICENSE SUSPENSIONS & OCCUPATIONAL LICENSES

If your license does become suspended, we may be able to help you get a special "occupational license." This will allow you to continue driving to go to and from work, school, doctor, etc, and perform all necessary houseshold tasks. The judge can place time and day restrictions, but we are usually able to get them to be effective 7 days a week, from 7:00 a.m. to midnight.

In order to get this license, there are several fees you will have to pay. You will have to pay the filing fee to the court of $350 (as of 10/22). You will have to get an SR-22 insurance form which can also cost a few hundred dollars. You will also have to pay a license reinstatement fee to Texas Department of Public Safety (DPS) of $135.

OTHER OFFENSES IN THE MUNICIPAL OR JP COURT

There are many other small time offenses a person may be charged with in the Municipal Court or JP Court. These include simple assault, shoplifting, possession of drug paraphernalia, and minor in possession of alcohol. Many times people just simply pay a fine on these charges and assume they are not going to harm their record. Unfortunately, this is not true.

Having a conviction on your record for any of these type of offenses can do serious damage to your record. It could also prevent you from ever getting a student loan, or possibly from being able to own a firearm. There can be other negative consequences as well.

If you hire us to help you out, we can almost always get the charges dismissed instead. Sometimes we can get them dismissed right away, and other times with a short period of "unsupervised probation." Both of these outcomes are far better for your record in the long run than simply paying the fine. Handling the case this way also leaves open the option to get these charges "expunged" from your record later. (See criminal law section for more information).
